YouTuber Dhruv Rathee made headlines with his legal battle with BJP leader Suresh Karamshi Nakhua, who filed a defamation case against him. Now, in the recent development in the case, there is a relief for Rathee as Delhi Court on Tuesday granted time to file a reply to the plea.
Dhruv Rathee Legal Battle Continues:
Rathee's lawyer has asked for extra time from the court and said that his client is not in India currently, and he would therefore have to seek instructions from him. Reacting to the statement, advocate Raghav Awasthi, appearing for Nakhua, said, "This is the age of email service."
The court directed replies to be filed and listed the case for arguments on August 16.
In his defamation case against Rathee, Nakhua has filed an application order 39, Rules 1 and 2, asking for a temporary injunction stating that the tweets posted by the defendant are causing substantial harm to his reputation.
During the hearing, Rathee's counsel highlighted that the court fee filed by Nakhua is deficient, and until and unless proper court fees are filed, the matter cannot be proceeded with.
It was further submitted that some reasonable grounds have to be given for not filing proper court fees which are missing in the application of the plaintiff. The court thereafter directed Nakhua's counsel to file court fees within a week.
About the Controversy:
Rathi uploaded a video titled, 'My Reply to Godi Youtubers | Elvish Yadav | Dhruv Rathee' on his YouTube channel. Nakhua claimed that Rathi in his video alleged that "PM Modi had hosted violent and abusive trolls like Ankit Jain, Suresh Nakhua, and Tajinder Bagga at his official residence."
About the Case:
Nakhua in his suit filed against Rathi, Google LLC, and X Corp (formerly known as Twitter) submitted that Rathi had on July 7 uploaded a video titled “My Reply to Godi Youtubers | Elvish Yadav | Dhruv Rathee” where he referred Nakhua as a part of violent and abusive trolls for “no rhyme or reason” to bring down his reputation.
