Step 1: Send a Legal Notice-

The first step is to consult a good lawyer with your employment contract and bank statements. 

A legal notice can be sent to your employer, often prompting for a swift payment to avoid any further legal trouble.

Step 2: Approach the Labour Commissioner-

If the legal notice doesn't completely resolve the issue, escalate the matter soon to the Labour Commissioner. This government authority will then try to fully mediate. 

If it's unresolved, the matter can be taken to court and action can be taken.

Step 3: File for Recovery Under the Law-

Meenal explains the two legal options based on your job level:

For Employees/Workers: File under the Section 33(c) of the Industrial Disputes Act, 1947 to claim your unpaid salary.

For Managers or Executives: Use Order 37 of the Civil Procedure Code (CPC), 1908 to file a Summary Suit—a much faster route for the salary recovery in civil court.
